Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MagicWP managed WordPress hosting service and related products provided by MagicWP Inc. (“MagicWP”, “we”, “us”, or “our”). By accessing or using the service, you agree to these Terms.
Acceptance
By creating an account or using the service, you agree to these Terms and our Privacy Policy. If you are using the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Account
You must provide accurate and current information when creating an account. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You must be at least 16 years old to use the service.
Subscription and billing
The service is billed on a subscription basis. By subscribing you authorize us (via Stripe) to charge the applicable fees to your payment method. Subscriptions renew automatically at the end of each billing period unless cancelled.
Fees are non-refundable except as required by law or as explicitly stated in our documentation. You may cancel at any time; cancellation takes effect at the end of the current billing period.
We may change prices with at least 30 days’ notice. Continued use after a price change takes effect constitutes acceptance.
Acceptable use
You agree not to use the service to:
- Violate any law or third-party rights
- Host or distribute malware, phishing pages, or other malicious content
- Send unsolicited bulk email (spam)
- Attempt to disrupt, overload, or compromise the service or other customers
- Reverse engineer or attempt to extract source code, except where permitted by law
- Resell the service without our written agreement
We may suspend or terminate accounts that violate these rules.
Service availability
We strive to provide a reliable service and back this with a Service Level Agreement (SLA) where applicable. Scheduled maintenance, third-party outages, and force-majeure events are excluded from SLA calculations.
Intellectual property
The MagicWP service, including the dashboard, documentation, and branding, is our property and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the service in accordance with these Terms.
Your content
You retain all rights to the content you upload to the WordPress sites you host with us. You grant us a limited license to host, store, process, and back up your content as necessary to provide the service. You are responsible for ensuring you have the rights to your content and that it complies with applicable law.
Termination
We may suspend or terminate your account for material breach of these Terms, fraudulent or abusive activity, or non-payment. You may cancel your account at any time from the dashboard. Upon termination, your right to use the service ceases and we will delete your data after the retention period described in our Privacy Policy.
Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
Limitation of liability
To the maximum extent permitted by law, MagicWP will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or use, arising from your use of the service. Our total liability for any claim arising out of these Terms will not exceed the amount you paid us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold us harmless against any claims, damages, or expenses arising from your content, your use of the service, or your violation of these Terms.
Governing law
These Terms are governed by the laws of the jurisdiction in which MagicWP Inc. is incorporated, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction unless mandated otherwise by applicable law.
Changes
We may update these Terms from time to time. Material changes will be communicated via email or in-product notice at least 30 days before they take effect. Continued use after changes take effect constitutes acceptance.
